On June 16, 2009, Building Materials Holding Corporation and all of its subsidiaries (collectively, "BMHC") filed voluntary petitions for relief under chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware (the "Bankruptcy Court").
On December 14, 2009, BMHC filed its Joint Plan of Reorganization under Chapter 11 of the Bankruptcy Code Amended December 14, 2009 (with Technical Modifications) (the "Plan"). On December 17, 2009, after notice and a hearing, the Bankruptcy Court entered an order confirming the Plan (the "Confirmation Order"). Pursuant to the Plan and the Confirmation Order, the Plan's "Effective Date" was January 4, 2010.
